<p><strong>17 year-old Congolese girl missing in Parow<a href="http://www.passop.co.za/wp-content/uploads/2012/02/Benedict.png"><img class="alignright size-full wp-image-1477" title="Benedict" src="http://www.passop.co.za/wp-content/uploads/2012/02/Benedict.png" alt="" width="220" height="293" /></a></strong></p>
<p>On Thursday the 16th February around 7:00 am, Benedict Ngindu Siku left her house for Windermere High School, heading for the Parow train station.  When his daughter did not return that afternoon, her father Ngindu became very concerned and contacted the Parow Police Station.  They told him to wait for the night and see if his daughter showed up by the morning.</p>
<p>Benedict did not show up the next morning though, and Ngindu was informed by the school that Benedict never made it there on Thursday.  Ngindu has not seen his daughter since.  He did receive a phone call around 3am on Sunday morning from a woman who said that she was with Benedict at the Cape Town train station.  This woman was meant to drop Benedict off at Ngindu&#8217;s house in Parow around 1pm on Sunday when she returned home from work.  However, Benedict was not there when the woman returned home from work, and she called Ngindu and said that she did not know where Benedict had gone.  The woman was calling from a private number, and when Ngindu asked for her contact information, she did not reply. Only after this happened on Sunday, almost 72 hours after she was first reported missing, did the Police agree to open a case and investigate the matter.</p>
<p>The case is currently being handled by the Parow police station in conjunction with Missing Child South Africa and Passop.  Benedict is a 17 years old Congolese girl, around 1.6m tall and has a slim build.  She was last seen wearing her Windermere High School uniform &#8211; a white blouse, white skirt, white socks, and black shoes.</p>

			<content:encoded><![CDATA[<p>Below is the latest list of new ZDP permits. It is a comprehensive list for 2012 (including the latest list from Jan 29th, as well as from Jan 20th and Jan 4th). These permits are ready for collection at Bellville Home Affairs.</p>

<p align="center"><strong>FOR IMMEDIATE RELEASE</strong></p>
<p><strong>PASSOP welcomes the sentencing to 18 years in prison of the men found guilty of murdering lesbian Zoliswa Nkonyana.</strong></p>
<p>The court in Khayelitsha has sent a strong message by finding that the men who killed Ms. Nkonyana did so because she was living openly as a lesbian and that this warranted the harshest penalty. The message is that such hate crimes and blatant homophobia will not be tolerated in South Africa.</p>
<p>We hope that this message is heard loud and clear across the rest of the continent, where homophobic discrimination is widespread and where homosexuality is a crime. Our <a href="http://www.passop.co.za/lgbti-refugee-advocacy" target="_blank">new project</a> works to assist and advocate for the rights of gay and lesbian refugees who have been forced to flee their home countries and are seeking refuge in South Africa.</p>
<p>Although in many parts of South African society homophobia is still prevalent, today we are proud that South Africa’s legal system has upheld our Constitution and has set an example to the rest of Africa to follow.</p>
<p>We commend the efforts of the all activists and civil society organisations who have been fighting for this day.</p>

<p><span style="font-family: georgia, serif; font-size: medium;">Comrades Ronnie Kasrils and Amina Frense will be signing the marriage register at the Wynberg Home Affairs office at 10 am tomorrow on Thursday the 2<sup>nd</sup> of February.</span></p>
<p><span style="font-family: georgia, serif; font-size: medium;">They have through their lives stood for human rights, for an integrated society free from racism, colonial occupation and dispossession, </span><span style="font-family: georgia, serif; font-size: medium;">homophobia, </span><span style="font-family: georgia, serif; font-size: medium;">pov<wbr>erty and xenophobia. It is in this light that they have chosen to invite a group of </wbr></span>activists to witness the event and celebrate this great union.</p>
<p><span style="font-family: georgia, serif; font-size: medium;">As Cde Ronnie Kasrils is a board member of PASSOP (which campaigns on the above issues) they have also decided to hold a small get together after the signing at PASSOP’s office across the street in Wynberg. It is both a privilege and honor to be part of this joyous occasion; they have inspired many activists to stand up for what they believe in and they have great future ahead.</span></p>

<p><strong>PASSOP shocked that Maitland police station refused to allow assaulted asylum seeker his right to lay charges against Home Affairs security guards.</strong></p>
<p>We were extremely concerned to observe the assault of Zimbabwean asylum-seeker Mr Lucky Dube by security guards at the</p>

<p>Maitland refugee reception centre yesterday morning. A crowd of people witnessed Mr Dube being beaten by three security guards and punched in the face until he was bleeding from a cut on his head. He collapsed (fainted) and was taken to hospital by ambulance.</p>
<p>We were later informed that after he left the hospital the Maitland police denied him his right to lay charges against the perpetrators. The police on duty told Mr Dube that ‘because he had not left the centre when told to by the security guards, he had no right to lay assault charges’. While in fact he was legally bound to present himself at refugee reception centre to resolve his documentation situation.</p>
<p>In response, PASSOP this morning sent our head paralegal officer, Mr Langton Miriyoga, to assist Mr. Dube to lay charges against the security guards who assaulted him. Although he was escorted by Mr Miriyoga, the police again refused to allow Mr Lucky Dube his right to lay charges. Their excuse for this was because his documents had expired &#8211; the very reason he was at the refugee centre where he was assaulted.</p>
<p>Refusing the right to access justice is unconstitutional. The Maitland Police’s actions were unlawful and they are acting as if they were in collusion with the perpetrators at the Refugee Reception Centre.</p>
<p>The case of Mr. Dube is just one of the examples of the type of injustices that refugees, asylum seekers and immigrants have to suffer in the face of SAPS officers who are xenophobic, or at best, apathetic to the plight of non-nationals.</p>
<p>We have written to national Minister of Police and will be lodging complaints with both the ICD and the Human Rights Commission. We will also be engaging our legal partners to ensure that Mr Dube will get his right to lay charges against those who assaulted him. We have already been assured that Mr Dube will be assisted by Home Affairs on Monday and we will accompany him to ensure that he is safe.</p>

<p align="center"><strong>FOR IMMEDIATE RELEASE</strong></p>
<p align="center"><strong>PASSOP is happy with the high percentage of Zimbabwean ‘ZDP’ permits approved and the Department of Home Affairs undertaking to extend this special dispensation to other SADC countries</strong></p>
<p>We are content that the majority of work (study and business) permits for Zimbabweans have been approved by the South African Department of Home Affairs (DHA). The DHA announced last week that of the 275,762 applications, 255,282 had been approved and only 20,480 applications were “still to be finalized”.</p>
<p>Over the past year PASSOP has had monitors at one of the offices where applicants collect their permits and we are pleased with the low rejection rates that we have observed. The project was met with much suspicion from Zimbabweans and civil society alike, many of whom were concerned that a large number of permit applications would be rejected. We are pleased that the DHA seems to have proved the skeptics of this process wrong.</p>
<p>However, we hope that all of the approved permits will now be expeditiously issued, as it has been over a year since applications were made – a delay that has adversely affected many applicants.</p>
<p>Finally, we welcome the DHA’s undertaking to identify the next SADC country whose Diaspora will be given an opportunity to benefit from a “special dispensation” documentation project. We hope that they will indeed allow the Diaspora from <strong>all </strong>other SADC countries to eventually benefit from this progressive policy.</p>

<p align="center"><strong>PASSOP supports Minister Nkosazana Dlamini-Zuma’s AU bid</strong></p>
<p>We would like to add our voice in support of Dr Nkosazana Dlamini-Zuma’s bid to be elected chairperson of the African Union (AU). We encourage other civil society organizations to do the same.</p>
<p>South Africa’s large immigrant communities are here largely as a result of failed policies and conflict in their countries of origin. We believe that such forced migration will never be adequately addressed without deeper regional and continental cooperation.</p>
<p>South Africa has a responsibility to show much stronger leadership on the continent and we feel that Dr. Dlamini-Zuma’s election is a good step in that direction because she is one of South Africa’s most prominent politicians. Her election would allow South Africa to position itself better to unite Africa and fulfill its regional responsibilities.  We are confident that she will have the interests of Africa&#8217;s millions of vulnerable migrants at heart and will be able to achieve a lot to improve their plight.</p>

<p>We write this letter to express <strong>our sincere appreciation </strong>of the manner in which your Department’s officials working on the ZDP project at Bellville have been assisting Zimbabweans. During the past year when we were closely monitoring the implementation of the project, we have not witnessed any corrupt tendencies from the officials, neither have we received any such reports from the Zimbabweans who applied at that office. We appreciate that a corrupt free environment is achieved both through good oversight and through honest motivated staff. We have always hoped to see this level of integrity and probity within the Department, especially when officials deal with the vulnerable (immigrants, refugees and asylum seekers). This amounts to good administrative practice and should be applauded.</p>
<p>They have worked tirelessly through the holiday season and continued to treat their clients with respect.</p>
<p>Sadly we have received reports of other offices failing to achieve this level of performance and encourage the department to use this office (and its staff) as an example to other offices.</p>
<p>Therefore, please receive our compliments for the work well done by you and your officials at Bellville, we hope that this feedback will be well received.</p>
